Buyer Claims Guide

This guide explains how and when buyers may submit a claim under a Realty Guardian® Buyer Safeguard Plan. It outlines required timelines, documentation, and the review process. This page explains process only and does not expand coverage.

Important: Realty Guardian® Safeguard Plans are not insurance. Claims are reviewed for reimbursement consideration and are subject to plan terms, eligibility requirements, documentation, and submission deadlines.

Who May Submit a Buyer Claim

A buyer claim may be submitted by a buyer whose Guardian Agent properly enrolled the Buyer in a Buyer Safeguard Plan for the transaction and whose claim relates directly to a covered safeguard tied to that transaction.

Buyer Claim Submission Deadlines

Legal Counsel / Legal Expense Claims

Legal-related buyer claims must be submitted no later than six (6) months after the closing date. The claim must be opened within this six-month period.

Earnest Money Claims

Earnest money must remain unreturned for at least three (3) months following contract failure or termination. If not returned after this period, a claim may be submitted and must be filed within forty-five (45) days after the three-month maturity period ends.

All Other Buyer Safeguard Claims

All other buyer safeguard claims must be submitted within forty-five (45) days of the transaction outcome date: the closing date if the transaction closed, or the contract termination/failure date if it did not.

Required Documentation

All buyer claims must include core documentation plus claim-specific documentation.

  • Executed purchase agreement and applicable addenda
  • Closing statement or termination documentation
  • Proof of enrollment in the Buyer Safeguard Plan
  • Government-issued identification
  • Proof the expense was actually incurred and paid

What Is Not Covered

  • Market value changes or lost opportunity
  • Lost profits or anticipated gains
  • Emotional distress or inconvenience
  • Commission disputes
  • Expenses not listed in the Buyer Safeguard Plan
  • Claims submitted outside required timeframes

Claim Review Process

Claims are reviewed after all required documentation is received. Most complete claims are reviewed within 10–14 business days. Submission of a claim does not guarantee reimbursement.
